These general terms and conditions of sale create a legal agreement and apply to all orders and all sales of services and products concluded between the Client (referred to as “the Client”) and Mobility Sport Challenge (referred to as “the Coach”). They are fully and unconditionally accepted by the client. The Coach reserves the right to modify these general terms and conditions at any time. Each order is governed by the general terms and conditions applicable on the date of the order.
ARTICLE 1 – PURPOSE
The Coach offers coaching services as presented on his website: www.mobilityschallenge.com
One session corresponds to one hour (variable depending on the services offered) of sport unless special conditions are arranged with the Client.
The Coach has professional liability insurance. The Coach cannot be held responsible for indirect damages related to his coaching services. Booking one or more sessions constitutes an order by the Client and implies unconditional acceptance of these general terms and conditions of sale, unless specific conditions have been agreed upon by the Coach with the Client. Any other document besides these general terms and conditions of sale—particularly those displayed on the Coach’s website and social networks, catalogs, brochures, advertisements, notices—are for informational purposes only and are not contractual. These general terms and conditions of sale form an indivisible contractual document with the service quotation issued by the Coach and accepted by the Client.
ARTICLE 2 – SERVICES, PRICES & PAYMENT TERMS
Prices are expressed in euros (€) and are displayed inclusive of all taxes. Prices listed on the website www.mobilityschallenge.com may be subject to change without notice or prior information. If they vary, any previously confirmed service will retain the rate applicable at the time of order. Payment by bank transfer or in cash is offered to the Client. Any fees related to payments made in foreign currency are entirely the responsibility of the Client. No discount for early or cash payment may be granted. Non-payment of the balance results in cancellation of the planned sessions. A session purchase system is offered to the Client.
“Subscription” means the effective payment date of the session package by the Client to the Coach.

ARTICLE 3 – TRAVEL
The Coach’s service area includes the municipalities of Bayonne, Biarritz, Anglet, Bidart, Saint-Jean-de-Luz, Urt, and their neighboring towns. The Coach reserves the right to accept or refuse coaching in a municipality outside his service area. The Client may be charged additional travel fees beyond 15 km from the BAB zone. In the event of the Client moving to a location outside the Coach’s service area, travel fees will be freely set by the Coach and charged for the remaining sessions in the Client’s package.
ARTICLE 4 – PERFORMANCE OF THE SERVICE
The Coach is not bound by an obligation of result. He undertakes to use all available means to provide quality coaching to achieve the Client’s expected result. The content of the sessions is at the full discretion of the Coach.
ARTICLE 5 – CLIENT’S OBLIGATION
The Coach requires the Client to provide a medical certificate of fitness for sports practice dated within the last three months. If the Client does not provide such a certificate, the Coach declines any responsibility that may arise as a result. The Client agrees to wear suitable attire for sports practice. The agreed session time is binding, and any delay by the Client may be deducted from the scheduled session time. A delay exceeding 15 minutes will result in the session being cancelled and deducted from the Client’s package.
ARTICLE 6 – COACH’S OBLIGATION
The Coach agrees to arrive at the agreed time for sessions with the Client. In the event of a delay greater than 15 minutes, the session will be rescheduled. No refund can be claimed, and a new date will be mutually agreed upon. In case of the Coach’s unavailability for a scheduled session, the Coach agrees to inform the Client as soon as possible. No session will be deducted from the Client’s package. The services offered by the Coach will be unavailable during his annual leave. He agrees to inform the Client fifteen days prior to his absence. The unavailability period will extend the validity of the session packages accordingly.
ARTICLE 7 – COACHING LOCATION AND TIME
Coachings are conducted at the Client’s home, in public spaces, or in reserved fitness rooms, depending on the activities and availability of venues. The Client and the Coach agree together on the session time according to their mutual availability.
ARTICLE 8 – CANCELLATION AND REFUND
No refund will be given for purchased and unused sessions within the time limits set in Article 2 due to the Client moving. No refund may be claimed from the Coach if the Client’s goals are not fully or partially achieved. The Client may request a refund for purchased and unperformed sessions in cases of force majeure. Either party may invoke this right when force majeure is established. In case of an epidemic or pandemic, sessions will be offered via video conferencing, and no refund may be requested by the Client. If the Client does not wish to take part in online classes, they will be rescheduled to a later date.
A Client who has committed to a discounted rate may not cancel a session, except in the event of duly justified force majeure. The Coach will offer three rescheduling options. If none are accepted by the Client, the session will be deducted from their package.
ARTICLE 9 – PAYMENT FOR SESSIONS
For the purchase of a session package, the Client must pay the full amount of the package at the time of subscription.
ARTICLE 10 – APPLICABLE LAW
The contractual relationship between the parties to which these general terms apply is governed exclusively by French law. Any dispute relating to the formation, execution, or interpretation of these general terms and to any agreements they apply to shall, failing an amicable agreement, fall under the exclusive jurisdiction of French courts. Any legal action must be brought before a court located in the Coach’s department of residence. The Client acknowledges having read and understood the general terms and conditions of sale above.
